I. ORGANISATION, FUNCTIONS AND DUTIES :

a) Organisation:- Prison is under State subject . Mizoram Prison Administration, in the real sense of the term, has emerged only after Mizoram was elevated from the status of one of the Districts of Assam into a Union Territory. As such, Mizoram Jails in the initial stage of development were under Central Administration till Mizoram became a State. During this period, Prison administration was mainly concentrated in security custody and confinement of prisoners. Now, with the modern concept of Prison, the Department is making energy effort to take up the security aspect and reformation of prisoners on equal facting.
Under Prison Department there is a Directorate headed by I.G.Prison and under him there are one D.I.G. and one A.I.G. There are five District Jails located at Aizawl, Lunglei, Saiha, Champhai and Kolasib and a Central Jail at Aizawl. The District Jails are looked after by Jail Superintendents and the Central Jail by a Special Superintendent. Under the Jail Superintendent, there are Jailor, Assistant Jailor, Chief Head warder, Head warder and Jail warder. There is one Doctor for Central Jail and District Jail, Aizawl.

(b) Functions and duties:-

The Prisons Department in the State protects society and endeavours to reform and re- assimilate offenders in the social environment by giving them appropriate Correctional treatment.

II. POWERS AND DUTIES OF OFFICERS AND EMPLOYEES
1. INSPECTOR GENERAL OF PRISONS

1. Control of Expenditure:
The I.G. shall exercise full control over all expenditure in jails, submitting annually to Government a budget of the amount of funds necessary for their maintenance in such manner and at such time as may be required.

2. Financial Powers:
The I.G. is empowered to sanction all working expenses within the limit of the budget grants, and also to regulate all contingent charges, which are authorised to be incurred without reference to superior authority.

3. Power to sanction temporary appointments:-
I.G. has authority to sanction in case of necessity and subject to budget provision, temporary appointment of Jailor and subordinate Jail Officials in the Prison Department.

Powers of transfer and punishment:-
He may transfer or punish or terminate Jailor and subordinate Jail Officials except Jail Superintendent and Medical Officer.

5. Power to order transfer of prisoners:-
Under 29(2) of Act III of 1900, as amended by Act I of 1903 (the Repealing and Amending Act 1903) he has been vested with the ordering the transfer of prisoners from one jail to another within the State. He is also authorised without reference to the State Government to sanction the removal of prisoners from the permanent buildings of any jail into temporary quarters during epidemics.

6. Powers as a Magistrate:-
He is vested with the powers of a Magistrate of the 1st class within the limits of every prison in his jurisdiction

7. Duties:-
He shall inspect every Jail at District headquarters at least once a year and of every sub jail at sub-Divisional headquarters at least once in two years.

2) DEPUTY INSPECTOR GENERAL OF PRISONS
DIG Prisons is the I.G’s immediate Officer whose duty is to take place whenever I.G. is absent and to undertake whatever portions of the IG’s duty as may be delegated to him under proper authority. He shall inspect any Jails within the state on behalf of I.G

3) ASST.INSPECTOR GENERAL OF PRISONS
AIG Prisons is the DIG’s immediate Officer whose duty is to take place whenever D.I.G. is absent and shall undertake whatever portions of the DIG’s duty as may be delegated to him under proper authority. On every occasion on which he officiates for the DIG he shall possess all powers and responsibilities of that officer. He is authorised to inspect any jails within the state on behalf of I.G.Prisons.

4. JAIL SUPERINTENDENT:-
The Jails Superintendent shall manage the prison in all matters relating to discipline, labour, expenditure, punishment and control, subject to the orders of the Inspector General of Prisons. The Jail Superintendent shall obey the lawful orders of a District Magistrate in respect of the Prison.

Duties:- The duties of the Jail Superintendent in regard to offences and punishments, admissions and release, deaths, execution, accounts, etc. are prescribed in the Jail Manual dealing with those subjects. He shall make himself thoroughly acquainted with the Acts and Regulations relating to the Jails and with the rules contained in the Jail Manual and shall be strictly responsible for the due carrying out all such statutory provisions and rules and for the execution of all sentences on prisoners committed to his charge.
The Superintendent shall ensure that he will work with sincerity and deal with issues like corruption, discipline, training, welfare, implementation of the provisions of the Jail Manual and Correctional programmes efficiently. Every order of the Superintendent shall be subject to the revision of the I.G.

XII. The manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes.

Prison Department does not have subsidy programmes and individual beneficiary programmes.

XIII. Particulars of recipients of concessions, permits or authorisations granted by it.

These subjects are not dealt in Prison Department.

XIV. Details in respect of the information available to or held by it, reduced in an electronic form.

Informations can be had from the Directorate of Prisons, Mizoram, Aizawl.

XV. The particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use.

The Prison Department does not have library or reading room for public use.
